Consistent with the permissions you give KZN to collect the information, KZN may use the information collected, including your personal information:

• to provide, personalize, and improve your experience with the Services and products, and advertising (including for third party products and services) made available on or outside the Services (including on other sites that you visit), for example by providing customized, personalized, or localized content, recommendations, features, and advertising on or outside of the Services;
• to ensure technical functionality of the Services, develop new products and services, and analyze your use of the Services, including your interaction with applications, advertising, products, and services that are made available, linked to, or offered through the Service;
• to communicate with you for Services-related or research purposes including via emails, notifications, text messages, or other messages, which you agree to receive;
• to communicate with you, either directly or through one of KZN’s partners, for marketing and promotional purposes via emails, notifications, or other messages, consistent with any permissions you may have communicated to KZN (e.g., through your KZN account settings);
• to, if you explicitly provide us your permission, use your mobile phone number to send you informational, marketing and promotional text messages using an automatic dialing system; you are not required to provide consent as a condition of signing up for KZN’s Services;
• to enable and promote the Services and other services or products, either within or outside the Services, including features and content of the Services and products and services made available through the Services;
• to enforce this Policy, the Terms of Use, and any other terms that you have agreed to, including to protect the rights, property, or safety of KZN, its users, or any other person, or the copyright or otherwise protected content of the Service;
• to provide you with features, information, advertising, or other content which is influenced by your location and your location in relation to other KZN users; and as otherwise stated in this Policy.

This Notice at Collection is provided in accordance with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”). In the preceding twelve (12) months, KZN may have collected the following categories of personal information about California residents:

(a) Identifiers: real name, postal address, email address, telephone number, account name, IP address, device identifiers, and other similar identifiers.
(b) Customer records information: name, signature, address, telephone number, and financial information (such as payment card information processed by our third-party payment processor).
(c) Commercial information: records of subscriptions purchased, products or services obtained, and other purchasing or consuming histories or tendencies.
(d) Information regarding your interaction with the App, server log information, and the page you request.
(e) Geolocation data: general (non-precise) location derived from IP address, used to provide location-influenced features.
(f) Inferences: inferences drawn from the foregoing to create a profile reflecting your preferences, characteristics, and predispositions for purposes of personalizing the Services.
(g) Sensitive personal information: Health Data, including information concerning physical health, fitness, medical conditions, and dietary preferences, and account log-in credentials.
(h) Sources of personal information: directly from you when you register, use, or otherwise interact with the App; automatically when you use the Services (e.g., through server logs, cookies, and similar technologies); and from third-party service providers (e.g., payment processors).

Business or commercial purposes for collection: providing and operating the Services; processing transactions; personalizing your experience; communicating with you; ensuring security and preventing fraud; complying with legal obligations; and as otherwise described in the “How we use the information we collect” section above.

Categories of recipients: service providers and contractors (including payment processors, hosting providers, and analytics providers); trainers, fitness professionals, and nutritionists, subject to confidentiality obligations; and governmental authorities or other persons when required by law, as described in the “Information Sharing and Disclosure” section below. KZN does not “sell” or “share” personal information as those terms are defined under the CCPA. See the “Do Not Sell or Share My Personal Information” section below.

KZN does not rent, sell, or share personal information about you with other people or non-government organizations except to provide the Services you've requested, when KZN has your permission, or under the following circumstances:

• KZN responds to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims;
• KZN believes it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of KZN’s Terms of Use, or as otherwise required by law.
• In the event that KZN is sold, acquired, merged, or reorganized with another entity, your personally identifiable information may be disclosed or transferred to the successor entity. In such event, KZN will use reasonable efforts to notify you of such transfer and to ensure that the successor entity is bound by privacy protections substantially similar to those set forth in this Policy.

KZN does not “sell” your personal information or “share” your personal information for purposes of cross-context behavioral advertising, in each case as those terms are defined under the CCPA. KZN does not knowingly sell or share the personal information of consumers under sixteen (16) years of age. To the extent KZN’s practices change such that any sale or sharing of personal information occurs, KZN will update this Policy and provide California residents with a clear and conspicuous mechanism to opt out of such sale or sharing in accordance with applicable law. California residents may also exercise their right to opt out by submitting a request to the contact address provided in the “Your California Privacy Rights” section below.

In connection with the Services, you may voluntarily provide health and fitness-related information, including but not limited to physical measurement, fitness goals, dietary preferences, medical conditions, allergies, exercise history, and progress data (collectively, “Health Data”). We treat Health Data with heightened sensitivity and do not sell or share it with third parties for marketing purposes. Health Data may be used solely to personalize your experience, deliver the Services, and enable trainers or fitness professionals associated with the App to provide you with tailored content and recommendations. You acknowledge that the provision of Health Data is voluntary and at your own risk. Health Data is classified as “sensitive personal information” under the California Privacy Rights Act (“CPRA”). California residents have the right to direct KZN to limit the use and disclosure of their Health Data to that use which is necessary to perform the Services or as otherwise permitted. To exercise this right, please submit a request as described in the “Your California Privacy Rights” section below.

Certain features of the App may involve interaction with trainers, fitness professionals, nutritionists, or other third-party content creators. In order to provide you with personalized services, limited personal information and Health Data may be shared with these individuals, subject to confidentiality obligations. KZN is not responsible for the independent actions of third-party content creators outside the scope of the App.

The App is not directed to children eighteen (18) years or younger. KZN does not knowingly collect personal information from children 18 and under. If you are a parent or guardian and believe that your child has provided us with personal information, please contact KZN so that appropriate action is taken. If a minor, eighteen (18) years old or younger uses the App with parental or guardian consent, the parent or guardian assumes full responsibility for the minor’s use of the App and the information provided.

KZN retains your personal information for as long as your account is active or as needed to provide you with the Services. KZN may also retain and use your information as necessary to comply with legal obligations, resolve disputes, and enforce agreements. Upon account deletion, KZN will delete or anonymize your personal information within a reasonable period, except where retention is required by applicable law. The criteria we use to determine retention periods for each category of personal information include: (i) the duration of your active account and the period necessary to provide the Services; (ii) any legal, tax, accounting, or reporting obligations to which KZN is subject; (iii) the period during which a claim or dispute could arise from our relationship with you; and (iv) the sensitivity of the information and the potential risk of harm from unauthorized use or disclosure. By way of example: (a) account registration and profile information is retained for the duration of your account plus up to twelve (12) months thereafter for legitimate business purposes; (b) transactional and billing records are retained for the period required under applicable tax and accounting laws; (c) Health Data is retained only for as long as necessary to provide the Services and is deleted or de-identified upon account deletion, unless a longer retention is required by law; and (d) server log and IP address information is typically retained for no more than twelve (12) months.

• KZN may set and access KZN cookies on your computer.
• KZN may use web beacons to access KZN cookies inside and outside our network of web sites and in connection with the App’s Services.

• KZN limits access to personal information about you to employees or contractors who KZN believes reasonably need to come into contact with that information to provide the Services to you or in order to do their jobs.
• KZN has physical, electronic, and procedural safeguards that comply with federal regulations to protect personal information about you.

Your KZN account information is password protected. You are responsible for maintaining the confidentiality and security of your password and account credentials by taking reasonable measures to ensure these are not compromised. You must notify KZN immediately should you suspect that your password or account security has been compromised. KZN is not responsible for any unauthorized access to your account resulting from your failure to maintain the security of your login credentials.

You may access, review, correct, amend, or request the deletion of the personal information KZN holds about you at any time through your user account settings within the App. If you are unable to make changes through your account, or if you wish to request the deletion of your data, you may submit a request to info@kznfitnessprogram.com. KZN will respond to such requests within a reasonable timeframe. Please note that certain information may be retained as required by applicable law, for legitimate business purposes, or to complete any transactions that were initiated before the request. KZN does not charge fees for an individual to exercise these rights.

If you are a California resident, you have the following rights under the CCPA in addition to the general rights described above:

• Right to Know. You have the right to request that KZN disclose the categories of personal information collected about you, the categories of sources, the business or commercial purposes for collecting it, the categories of third parties with whom we have disclosed it, and the specific pieces of personal information collected about you during the preceding twelve (12) months.
• Right to Delete. You have the right to request that KZN delete personal information that we have collected from you, subject to certain exceptions (including, without limitation, retention necessary to complete the transaction for which the information was collected, detect security incidents, comply with a legal obligation, or for other internal uses reasonably aligned with your expectations).
• Right to Correct. You have the right to request that KZN correct inaccurate personal information that we maintain about you.
• Right to Opt-Out of Sale or Sharing. You have the right to opt out of the sale or sharing of your personal information. As noted in the “Do Not Sell or Share My Personal Information” section above, KZN does not currently sell or share personal information as those terms are defined under the CCPA.
• Right to Limit Use and Disclosure of Sensitive Personal Information. You have the right to direct KZN to limit the use and disclosure of your sensitive personal information (including Health Data) to that which is necessary to perform the Services or as otherwise permitted.
• Right to Non-Discrimination. KZN will not discriminate against you for exercising any of your CCPA rights, including by denying Services, charging different prices, or providing a different level of quality.
• How to Submit a Request; Verification. To exercise any of the rights described above, please submit a verifiable consumer request to KZN through your account settings within the App or by contacting us at the email address provided in the “How to Contact Us” section below. You may also designate an authorized agent to submit a request on your behalf. To verify your identity, KZN may ask you to confirm certain personal information that we already maintain about you and to provide a declaration under penalty of perjury where required. KZN will not use personal information provided in connection with a verifiable consumer request for any purpose other than to verify your identity and respond to your request.
• Response Timeframe. KZN will confirm receipt of your verifiable consumer request within thirty (30) business days and will respond to your request within sixty (60) days. Where reasonably necessary, KZN may extend the response period by an additional forty-five (45) days, in which case KZN will notify you of the extension and the reason for it within the initial sixty-day period.
